Terms of Service

Echolon is a desktop application developed and maintained by the Echolon project ("we", "us", or "our"). By downloading, installing, or using Echolon ("Software"), you ("user", "you", or "your") agree to these Terms of Service ("Terms"). Please read them carefully before using Echolon.
If you do not agree to these Terms, you must not download, install, or use the Software.
1. License Terms
- Personal Use: You may use Echolon free of charge for non-commercial, personal purposes such as hobby projects, learning, or personal tinkering.
- Commercial Use: Use of Echolon within a for-profit organization or for revenue-generating work requires a paid commercial license.
Open Source Note: Portions of Echolon are available under the MIT License at github.com/echolon-app/echolon. These Terms apply to official Echolon binaries distributed by the Echolon project. Use of the source code alone is governed by the MIT License.
2. Commercial License Terms
If you purchase a commercial license, the following terms apply:
- Individual Licenses: Individual licenses are assigned to a single person and email address and cannot be transferred to another person.
- Business Licenses: Business licenses are assigned to an organization and may be reassigned to other individuals within that organization.
- Lifetime Fallback License: If your subscription ends, you may continue using the last version of Echolon released while your license was active for commercial purposes, but you will not receive future updates or support.
- Device Limit: Each license may be activated on up to 3 devices by the same individual and is automatically enforced. Sharing licenses with others is prohibited.
3. License Restrictions
You agree not to:
- Use Echolon for commercial purposes without a valid license.
- Share, transfer, or sublicense your license to others (except for Business license reassignments within your organization).
- Remove or obscure any copyright, trademark, or other proprietary notices included in the Software.
4. Ownership and Intellectual Property
Echolon, including all intellectual property rights, is and remains the sole property of the Echolon project and its contributors. All rights not expressly granted to you under these Terms are reserved.
5. Updates and Support
We may release updates, bug fixes, or improvements to Echolon at any time. Updates are installed automatically but can be disabled in the application settings. We are not obligated to provide technical support but may choose to do so at our discretion.
6. Privacy and Data Collection
Echolon is designed to function offline and does not transmit API request data, environment variables, or secrets. Limited data such as license status, application version, or anonymized error information may be transmitted solely to operate licensing and improve stability. 7. Disclaimer of Warranties
Echolon is provided "as is" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that Echolon will meet your requirements, operate uninterrupted, or be error-free.
8. Limitation of Liability
To the fullest extent permitted by law, the Echolon project will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from or related to your use of Echolon. Our total liability under these Terms is limited to the amount you paid for Echolon in the 12 months preceding the claim.
9. Termination
These Terms are effective until terminated by either party. You may terminate these Terms by uninstalling and ceasing all use of Echolon. We may terminate your license at any time if you violate these Terms. Upon termination, you must cease use of Echolon except where continued use is permitted under a valid fallback license.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Software is used, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms will be resolved exclusively in the courts located in the jurisdiction where the Software is used.
11. Changes to These Terms
We may update these Terms from time to time. The most current version will be available on our website. By continuing to use Echolon after changes to the Terms become effective, you agree to be bound by the updated Terms.
